Terms of Service

Welcome to SunTea Canada ("SunTea", "we", "us", or "our"). These Terms of Service ("Terms") govern your use of our mobile application, website (including sunteabc.com), and any related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

2. Your Account

• Account sign-in uses your phone number and a one-time verification code sent by SMS.
• You are responsible for keeping your phone number and device secure. Any activity through your verified number is your responsibility.
• You agree to provide accurate information and to notify us promptly of unauthorized use.
• We may suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

3. Orders, Payments, and Pickup

Online ordering is processed through Toast, our third-party point-of-sale partner. Toast's own terms and privacy policy apply to order and payment data processed on their platform. SunTea is not responsible for delays, outages, or issues caused by Toast or by the payment processors they use.

All prices are listed in Canadian dollars (CAD) and are subject to applicable taxes. We reserve the right to change menu, pricing, and availability at any time without notice.

4. Rewards Program

• Members earn points for qualifying purchases at participating SunTea locations. Current earn and redemption rates are displayed in the app and on our website.
• Points have no cash value, are non-transferable, and cannot be exchanged for cash, refunded, or sold.
• We may adjust point balances to correct errors, reverse fraudulent transactions, or reflect returns.
• We may modify, suspend, or terminate the rewards program, or change the value of points, at our discretion with reasonable notice.
• Unused points may expire in accordance with program rules communicated in the app.

5. Gift Cards

Gift card balances displayed in the Service are synced from Toast. SunTea is not liable for lost, stolen, or unauthorized use of gift cards. Gift cards are redeemable only at participating SunTea locations and cannot be exchanged for cash except where required by law.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or related infrastructure.
• Reverse engineer, decompile, scrape, or otherwise misuse the Service or its APIs.
• Submit false personal information, impersonate another person, or use someone else's phone number without consent.
• Use the Service to send spam, harass others, or infringe on others' rights.

7. SMS and Verification Messages

By providing your phone number, you consent to receive SMS verification codes from us (or our verification provider) to sign you in. Standard message and data rates may apply. You can stop receiving verification messages by no longer using the sign-in feature.

8. Intellectual Property

All content in the Service — including the SunTea name, logo, designs, photography, menu copy, app interfaces, and website — is owned by SunTea Canada or our licensors and is protected by Canadian and international copyright and trademark laws. You are granted a limited, revocable, non-transferable license to use the Service for personal, non-commercial purposes only.

9. Third-Party Services

The Service integrates with third parties including Toast (ordering and rewards), Firebase (authentication), and map tile providers. We are not responsible for the content, policies, or practices of these third parties. Your use of their services is subject to their own terms.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

11. Limitation of Liability

To the maximum extent permitted by law, SunTea Canada, its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of or inability to use the Service. Our total liability to you for any claim arising under these Terms shall not exceed CAD $100.

12. Indemnification

You agree to indemnify and hold harmless SunTea Canada and its affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service at any time. Upon termination, your right to use the Service ends immediately; sections that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and governing law) will continue to apply.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a new "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict-of-laws principles. You agree to submit to the exclusive jurisdiction of the courts located in Vancouver, British Columbia for any disputes arising under these Terms.
